Mycity and Smscity services Terms of use

The terms of use ("Terms", "agreement") of Smscity and Mycity ( Collectively "the services") are as follows:

The services are a part of www.telavivcity.com website ("telavivcity" , "the site", "website" "us" "we") and are given to users that have completed the registration process properly and agreed to these terms.

Mycity provides the following services:

    - Open a user's account

    - Create a personal profile. The profile contains a personal picture, informative details, short personal statement, personal preferences, and more. There are 3 profile access levels - private profile, can not be accessed  by other users ("private profile'). Friends profile- can be accessed only be a person the user defined as a friend ("limited profile") and public profile - can be accessed by all of the site's users. ("public profile")

    - posting opinions. User can post opinions about an article, event or place. All of the users opinions will be presented on one page, which can be accessed by all site's users. Please note that the opinion access level is not by any way related to the personal profile access level. user's opinion can always be access by all of the users in the site.

    - receiving informative Email messages according to the user's preferences. At this point the informative content includes updates about the site, events and businesses. ("informative content")

    - Registering to VIPs club of various  businesses

    - Receiving marketing Email messages that includes, inter alia, special offers, recommendations, sales and other promotional or advertising information ("promotional content")

Smscity provides the following services:

    - receiving informative cellular text messages ("SMS")  according to the user's preferences. At this point the informative content includes updates about the site, events and businesses. ("informative content")

    - Receiving marketing cellular text messages ("SMS") that includes, inter alia, special offers, recommendations, sales and other promotional or advertising information ("promotional content")

Joining the services

In order to join Mycity one must have an active and genuine  Email address. Smscity requires the user to own , or legally posses (given the owner's consent) a cell phone. The cell phone must support incoming text message in Hebrew , and open to all content services.

The services are private and personal and are not to be transferred to any third party.

The use of the services relies upon accurate and true information given by the user, and particularly the user's Email address and Cell phone number.

User's Privacy

The site will be allowed to use information and details the user supplied in the joining process or use of services, and information gathered regarding the user's use pattern in the services and site (Cookies included), for the following matters:

    1. In order to improve the services, information and content the site and third parties are offering as a part of the services.

    2. In order to analyze statistic information and giving it to adversities, while keeping the information on a statistic, anonymous level.

    3. In order to contact the user

    4. In order to maintain the services.

    5. In order to keep track of the user's activity, given the terms of this agreement and under the Israeli law.

Every use of the details given by the user during the joining process, are under the Israeli Privacy act, 1981.

Information security

The site will take every reasonable measures to secure information given by the user. The site can not fully secure the information and communication system against unauthorized penetrations and forbidden use by third parties. There fore the site will not be hold liable, directly or indirectly, for any case of use of information given by the user,  as a direct or indirect result of unauthorized penetrations of others or actions that it  can not control.

Services Costs

Both information and promotional content are at no cost. Sending coupons through text messages costs 50 Agorot per coupon, Vat not included.

Content liability

The site tries to make the information on this web site as accurate as possible, but it is provided 'as is' and we accept no responsibility for any loss, injury or inconvenience sustained by anyone resulting from this information. You should verify information (like Times, addresses, costs and more) with the relevant bodies before you take any action.

The user is solely responsible for the photos, profiles and other content that the user publish or display ("post") on or through the Services or the Web site, or transmit to other Members (collectively the "Member Content"). You understand and agree that the site may review and delete or remove any Member Content that violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of Members or others.

The user is aware and fully accept that the site cannot prevent errors, malfunctions and mistakes in the informative and promotional content.

By posting Member Content to any part of the Web site, you automatically grant, and you represent and warrant that you have the right to grant, to the Company an irrevocable, non-exclusive, worldwide license to use, copy, perform, display, reformat, translate, excerpt (in whole or in part) and distribute such information and content.

Celular Text messages liability

The user is aware that transmitting text messages through the cellular operator ("cellcom", "Pelephone", "Orange" and "Mirs"), is subject to the limited cellular coverage and is aware of the nature of cellular communication, loss of calls and signal which are considered a norm, and the fact the in some areas in Israel the coverage may not be full or consecutive. The user will have no claim against the site regarding those merits.

Proprietary Rights
All content on the Web site, including but not limited to services, design, text, graphics, coupons  ("Site content"), are the proprietary property of the site or its licensors. No Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the sites written approval.

Member Conduct

The user understand that the Service and the Web site are available for personal, non-commercial use only. The user declares and agrees that no content of any kind submitted through your account will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, or unlawful material. . In addition, you agree not to use the Service or the Web site to:

• upload, post, email, transmit or otherwise make available any content that we deem to be harmful, threatening, abusive, harassing, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable;
• impersonate any person or entity, or falsely state or otherwise misrepresent yourself or your affiliation with any person or entity;
• upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials
• upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
• intimidate or harass another;
• use or attempt to use another's account, service or system without authorization from the Company, or create a false identity on the Service or the Web site.
• Given the user is not the owner of the cell phone provided by him for Smscity service, the user agrees and declares that the cell phone was given to him with the full consent of it's legal owner, and he will be the sole liable entity in case any claim will arise.

Changes and terminating the services

The site holds the right to change or terminate and part and/or all the services with no prior notification. The site will not be held liable for any damages caused to the user or third parties as a result of changes or termination of the services. The site will announce the termination on a location fully accessed and viewed by the users.

The SmsCity service will be terminated (Fully or partially) in any case in which the agreement between the site and the contractor or the contractor and the cellular operator will come to an end.

Governing Law and Venue
Any dispute relating in any way to the Web site and/or the Services shall be submitted to Tel Aviv court of law. The Israeli law shall govern this agreement.

Changing the agreement

The site may change the user agreement from time to time. The updated agreement can be accessed through www.telavivcity.com/eng/mycity-takanon.asp

The site recommends to view the agreement prior each use of the service, since the updated agreement terms applies to each visit.
